TutuDeals Platform Terms of Use

1.–Purpose – Service Description
1.1
The company under the corporate name “[…]” and the distinctive title
“…….”, with GEMI no.: … and Tax ID no.: … (Tax Office: [KEFODE Attica]),
having its registered office at …, ….. street, no. …., P.C. …., Athens,
Greece (hereinafter “Tutu Deals” or the “Company”), maintains this
online platform for electronic auctions and intermediation for the sale
and purchase of used and new vehicles (hereinafter the “Platform”). The
Platform provides brokerage services, vehicle inspections, auction
services, payment escrow services, vehicle storage, vehicle washing,
intermediation in the transfer of ownership, as well as purely
informational content regarding financing options offered by third-party
credit institutions, and also intermediation services for the transfer
of ownership for vehicles acquired by TutuDeals from vehicle rental
companies, as well as from companies managing vehicle fleets intended
for financial leasing. By providing these services, the Company does not
acquire the capacity of seller, buyer, or provider of credit services,
except as set out in clause 1.2 hereof.
1.2
In addition to the above, the Company may also participate in the Platform in the capacity of Seller, either itself or through affiliated businesses, or through companies within the same Group that are directly or indirectly controlled by it or exercise control over it, offering for sale vehicles in its full ownership (hereinafter the “Company-Owned Vehicles”) through the Platform.
In this case, and exclusively for transactions relating to the sale of Company-Owned Vehicles, the Company acts in the capacity of merchant/seller and not as a mere provider of intermediation or brokerage services. Consequently, for such transactions, the provisions concerning the neutrality of the Platform or the Company’s role as an intermediary do not apply; instead, the applicable regulatory framework governing sales contracts between a trader and a consumer or between traders, as the case may be, applies.
In particular, in cases of sale of Company-Owned Vehicles by the Company to consumers, Law 2251/1994 on consumer protection, Articles 513 et seq. of the Greek Civil Code on the contract of sale, and any other applicable provisions of EU and national legislation on commercial practices and consumer information apply.
In case of sale of Company-Owned Vehicles to professionals or traders, the general provisions of the Greek Civil Code on sale and any specific terms agreed between the parties apply, excluding the application of the special protective provisions of consumer law, to the extent permitted by law.
The Company's status as a seller will be stated in the corresponding vehicle listing on the Platform, ensuring that the user is aware, prior to participating in a direct sale or auction process, whether the Company is acting as a third-party intermediary or as a direct seller.[NKLaw1] [IF2]
For transactions in which the Company does not act as the seller of Company-Owned Vehicles, but solely as the provider of the Platform and as an intermediary, without bearing liability for the contractual obligations of the contracting parties, the provisions of Presidential Decree 131/2003 apply, in accordance with these Terms of Use.
The more specific terms for the sale of Company-Owned Vehicles—including pricing terms, method of payment, delivery, transfer of ownership, warranties, and liability—may be further detailed in special transaction terms and/or in separate contractual documents that will be made available to the buyer before completion of the transaction and, in the event of any conflict, shall prevail over the Platform’s general terms exclusively for that specific transaction.
1.3
These Terms of Use constitute a binding agreement between TutuDeals and any person who uses the Platform, whether as a seller or prospective buyer, as a bidder, as the highest bidder and buyer, or in any combination of the above capacities (for brevity, each such person shall hereinafter be referred to as (a) a “Party” and (b) together with TutuDeals, the “Parties”). Browsing the Platform, registering, listing a vehicle, or submitting a bid in an auction constitutes unconditional acceptance of these Terms of Use, which govern in their entirety the relationship between TutuDeals and the User.
The provision of auction services includes, indicatively and not limited to, the listing of a vehicle by TutuDeals upon the seller’s request, the registration and verification of the prospective buyer’s details, the submission of bids with financial consideration, the designation of the highest bidder (award), payment of the purchase price into a special bank account of TutuDeals, the management of the vehicle ownership transfer process, and the payment of a commission in favor of the Platform.
TutuDeals’ services are provided in real time and include all procedures and functionalities carried out “live” through the Platform, ensuring an immediate and interactive experience for vehicle sellers and buyers. TutuDeals provides, among others, the following services:
• Vehicle listing and presentation by TutuDeals in real time, with the ability to view photos, technical details, and vehicle history.
• Instant registration and verification of prospective buyers, to ensure the reliability and security of transactions.
• Conducting auctions in real time, with interested parties submitting bids within a specified time period.
• Designation of the highest bidder (award) immediately after the auction ends, with written notification to the parties involved.
• Managing payments through escrow in real time via a dedicated account of TutuDeals, ensuring secure payment of the purchase price.
• Support in the vehicle ownership transfer process.
• Vehicle storage and inspection services.
• Promotion of financing solutions in cooperation with banks.
TutuDeals’ real-time (“live”) services ensure the immediate, transparent, and secure conduct of the entire process—listing, auctioning, and buying/selling vehicles—providing the best possible experience to all Platform users.
2. User Categories – Seller and Buyer Obligations
Users participating in the operation of the Platform fall into the following categories, which correspond to the chronological order of each stage of the auction:
Unregistered visitors have access to limited content and features. More specifically, they can view all vehicles included in scheduled auctions, along with full technical specifications, photos, 3D viewing capability, and the relevant inspection report for each vehicle. In addition, a countdown to the auction date is displayed, as well as the initial starting price (“starting deal price”). However, unregistered users cannot see the Buy Now price, do not have access to listings for vehicles that have already been sold or their sale prices, cannot view upcoming vehicles that are to be auctioned, and cannot actively participate in auctions or place bids.
By registering on the Platform—which is free and addressed to both private individuals and professional dealers—the User gains access to additional features and information. Registered users can view vehicles that are in preparation and have not yet been listed for auction (“upcoming”), see the Buy Now price on available vehicles, and create a wishlist of vehicles they are interested in.
• Access to Sales History: Ability to view the sale prices of previous vehicles that have been awarded through the Platform.
• Participation in Auctions: Right to actively participate in auctions by submitting bids (“Bids”), unlike non-subscribers who do not have this capability.
• Access to Historical Data on Sold Vehicles: Ability to view the bid history and final sale price of vehicles sold through the Platform, in order to stay informed about market trends and price levels and to form a clear picture of market competitiveness.
Seller: The natural or legal person who intends to offer a vehicle for sale through the Platform’s services. After deciding to do so, they register on the Platform for free, accepting these Terms of Use, either as a private individual or as a dealer. They then provide the requested vehicle details on the Platform. After TutuDeals reviews and confirms these details, the seller enters into the Seller Agreement with TutuDeals so that the sale process can proceed in accordance with it.
Prospective Buyer: A User with an active subscription who, by submitting a bid, expresses their intention through TutuDeals to purchase the vehicle at a specific price, actively participating in the auction process.
Highest Bidder: The Prospective Buyer to whom the vehicle being auctioned is awarded as the highest bidder during participation in the auction process.
Buyer: The Highest Bidder who fully complies with these Terms of Use and the terms of the agreement entered into with TutuDeals and who, within three (3) business days from the award date, pays the full purchase price and, after the vehicle is transferred into their name, collects the vehicle from TutuDeals’ storage facilities.
3. Auction Process Description
Auctions are conducted electronically through the Platform, under the “auction to the highest bidder” model (“highest bidder wins”). Each auction has a predetermined start and end date and time, which are shown on the vehicle’s listing page.
In order to include a vehicle in the auction process, the Seller—who has accepted these Terms of Use, has read and understood the Information Notice on the Processing of Personal Data that is permanently posted on the website, has signed the sales agreement with TutuDeals, and is a registered User of the Platform—must, through their Platform account, complete the required fields and upload scanned copies or photos of the relevant documents in the Platform section [https://tutudeals.gr/el/dashboard/seller], submitting the necessary documents and information for the electronic listing of the vehicle for auction. The listing must be accompanied by photos of the vehicle, as well as any other information or document required to complete the process for selling the vehicle. Specifically, the Seller submits the following documents either in hard copy or scanned form:
• Vehicle registration certificate
• Valid vehicle insurance policy
• KTEO inspection
• Vehicle manufacturer (factory) details
• Vehicle license plates
• Proof of payment of road taxes
• ID card or passport
• Tax ID (AFM) and proof of issuance from the Tax Office (DOY)
• Damage report
• Certificate of no outstanding road tax liabilities
• Extra equipment/accessories (e.g., sunroof, window tint, roof box, etc.)
· Interior and exterior photographs of the vehicle.[IF3]

TutuDeals reviews the submitted information to decide whether to proceed to the next stage of the vehicle’s inspection, and the Seller is informed by phone or in writing (indicatively via chat or e-mail) whether the auction process for the vehicle offered for sale will continue. TutuDeals’ notice to the Seller that the process will continue shall hereinafter be referred to as “confirmation”.
If confirmation is provided, TutuDeals informs the Seller of a proposed auction starting price, based on TutuDeals’ experience and pricing calculation mechanisms. If the parties reach agreement on the auction starting price (hereinafter, for brevity, the “starting price”), a binding electronic agreement is concluded with the Platform, governed by these Terms of Use, the terms included in the Platform–Seller agreement, as well as any separate specific agreement or selected service relating to the posting and promotion of the vehicle. The agreement is concluded through the Seller’s electronic acceptance of the terms via the relevant checkbox or a digital signature.
The Seller then delivers the vehicle to the Company’s facilities at 28th km of the Athens–Lamia National Road, Afidnes 19014, either in person or via an authorized transport company. At the same time, the Seller submits in physical form—either original documents or certified copies of original documents (certified by the competent administrative authorities, a Citizens’ Service Center (KEP), or a lawyer)—all documents requested by the Platform for verification of their authenticity. Provided the Seller gives their consent through delivery of the vehicle, a technical inspection is carried out by TutuDeals. The technical inspection, the cost of which amounts to one hundred twenty-four euros (€124.00) including VAT, is performed exclusively by TutuDeals and is mandatory for the Seller. The above inspection fee includes: (a) the technical inspection carried out by TutuDeals, (b) photographing the vehicle with 2D and 3D photos, (c) washing the vehicle, and (d) in case the vehicle is not sold, delivery of the inspection report in PDF, accompanied by the 2D and 3D photos.
In any case, TutuDeals issues the official technical report that will accompany the vehicle to be posted on the Platform. Following completion of this technical report, the Seller, through their account, is informed of its content or uploads it themselves and is informed of the mechanical diagnosis. The Seller is informed in person, by phone, or through the Platform’s chat application of any new starting price proposed by the Platform [1].
If agreement is reached on the Starting Price [2], the vehicle is officially listed on the Platform and the starting price, the first auction start date, and the “Buy Now” price are set. At the same time, the original vehicle registration certificate is delivered to TutuDeals, so as to ensure that the vehicle remains in the Seller’s ownership throughout the auction process. If no agreement is reached, the Seller collects their car washed, together with TutuDeals’ technical inspection report, the 2D and 3D photos, and is charged only for the technical inspection in the amount of one hundred twenty-four euros (€124.00) including VAT, provided that the service has been supplied.
Before the start date of each auction, TutuDeals posts the vehicle listing with its basic information, and Subscription Users are notified that they can participate. During the auction, each participant submits a bid, which must be higher than the immediately preceding bid. The Platform displays all bids live, so that each User can monitor the progress of bids in real time. The Buy Now Price (“Buy Now” [3]) changes dynamically depending on the highest submitted bid, so that it remains continuously available as an option. A bid equal to or higher than the Buy Now Price does not end the auction, which is completed in accordance with the Platform’s operating terms or by exercising the “Buy Now” option. The direct purchase option (“Buy Now”) is available exclusively to Subscription Users at any time, either before the auction takes place or during the auction and before completion of the process, at the user’s discretion as to whether to participate in the auction or not. Upon award, the Highest Bidder is immediately charged a commission in favor of TutuDeals of 2% of the final price if the buyer is a private individual, or 1.5% of the final price if the buyer is a dealer. At the same time, the Highest Bidder receives instructions for payment of 100% of the agreed purchase price, at the latest within three (3) business days from the date of receiving said notice. The same notice also proposes that the Highest Bidder/Buyer may select additional optional services (such as transport, insurance, extra checks, etc.), the cost of which is added to the final amount due.
Payment of the full purchase price by the Buyer is made into a special bank account of TutuDeals, in accordance with the instructions provided by the Platform. If the Parties have chosen TutuDeals’ assistance for processing the ownership transfer, TutuDeals requests all additional documents required to complete that mandate and carries out the necessary actions. Following completion of the above actions, the vehicle is delivered to the Buyer either by self-pickup or via additional transport services, and the purchase price is sent to the Seller’s account after deduction of the following:
(a) A commission of 3.5% of the final price in favor of TutuDeals, as described in more detail in the TutuDeals–Seller Agreement
(b) The cost of the technical inspection
(c) Any other optional additional service selected by the Seller or the Buyer or both

6. Disruption of the Seller–TutuDeals Relationship
The Platform reserves the right, at its sole discretion, to remove the vehicle listing, to suspend, or to temporarily or permanently exclude the Seller from access to the Platform and/or from future auctions.
All rights are reserved to claim compensation for any direct or indirect damage suffered, such as marketing, advertising, photography, inspection, transport, or storage costs.
The Platform reserves the right to suspend, delay, or reject the publication of the vehicle listing in case of inaccuracies, omissions, or non-compliance with the above requirements.
If the vehicle is not sold in the first auction, the Seller has the right to freely decide either to participate in a subsequent auction or to withdraw the vehicle by collecting the vehicle and its registration certificate within five (5) business days from TutuDeals’ yard. In any case, the Seller is required to pay only the cost of TutuDeals’ inspection, which amounts to one hundred twenty-four euros (€124.00) including VAT.
If the sale is not completed and the vehicle must be returned, but the Seller unjustifiably refuses or fails to collect it within a reasonable period of time, TutuDeals is released from any further obligation of proper safekeeping and reserves the right to charge the Seller reasonable storage and/or transport costs, in accordance with the principles of good faith, commercial practice, and Article 826 of the Greek Civil Code. At the same time, the Seller is obliged, pursuant to Article 826 of the Greek Civil Code, to compensate TutuDeals for any damage arising from the deposit, unless the damage is due to fault of the custodian.
In any case, TutuDeals, as custodian, is not liable for any damage or loss that may occur to the vehicle during the deposit period, unless due to intent or gross negligence, in accordance with Article 914 of the Greek Civil Code.
If the Buyer does not pay the agreed purchase price, TutuDeals is not entitled to remuneration for its services from the Seller, provided the Seller is not at fault. TutuDeals may decide, at its sole discretion, whether the vehicle will be transferred to the second-highest bidder or whether the process will restart with a new auction.
If the Seller does not cooperate in the ownership transfer process and the transfer is not completed due to the Seller’s fault, the Seller owes TutuDeals the penalty clause under Article 5 as compensation.
If, after the award, the sale is not completed due to the fault of the Highest Bidder or the Buyer, the Seller is released from the obligation to pay any commission to TutuDeals.
7. Prospective Buyer Obligations and Declarations
8. Abnormal Development of Relations between Prospective Buyer and TutuDeals
TutuDeals is not liable for technical malfunctions or delays caused by third-party service providers, network outages, interference, force majeure, or user actions.
In the event of a technical error affecting the validity of an offer or auction, the Platform may restart or cancel the relevant process.
9. Obligations and Declarations of the Successful Bidder
The Successful Bidder is obliged to pay, within three (3) business days from the notification of award:
(a) the total price, into a special bank account of TutuDeals,
(b) the corresponding Platform commission, as defined in these Terms of Use (2% for individuals or 1.5% for traders),
(c) any other charge associated with optional services that may have already been selected (e.g., transport, storage, document management).
The payment of the price by the Successful Bidder / Buyer constitutes fulfillment of the Buyer's obligation to pay the price, provided that the price has been paid into the special bank account of TutuDeals.
Within forty-eight (48) hours from the notification of the vehicle award, the Successful Bidder must authorize TutuDeals to carry out all necessary actions for the transfer of the vehicle. In this case, within forty-eight (48) hours from the notification of the vehicle award, they must provide their signed authorization to TutuDeals via gov.gr, with explicit instructions for representation in all necessary actions required for the transfer of the vehicle, such as, in particular, signing contracts, submitting documents to the competent authorities, paying fees, and cooperating with the Seller.
10. Abnormal Development of Relations between the Successful Bidder and TutuDeals
Failure to pay on time constitutes a material breach and may result in the cancellation of the transaction and the pursuit of any direct or consequential damages suffered by TutuDeals.
In any event, the Platform reserves the right to proceed with the definitive charging of its commission amount in case of non-payment of the price by the Successful Bidder. The commitment, and where applicable, the withholding or charging of the amount is binding, irreversible, and executed without further notice or prior consent from the Successful Bidder, who hereby consents to the aforementioned charge through these Subscriber Terms of Use.
The Successful Bidder accepts that, in any case, payment of the price must be made within three (3) business days from the award. In the event of a breach of this obligation or delay, TutuDeals may retain the amount of its commission and reserves all its legal rights to compensation.
In the case of vehicle transport services provided to the Buyer by TutuDeals, the costs of transport and shipment of the vehicle are included in a separate invoice. All Parties agree and accept that the risk of loss, destruction, deterioration, or damage to the vehicle, from the moment of its delivery to the carrier, the carrier-agent, or any other authorized third party, shall be borne exclusively by the Successful Bidder. In the event of an accident or damage caused during the transport of the vehicle, the risk shall be borne by the Successful Bidder, who shall be solely and fully liable for the restoration of any damage caused. In any case, the place of performance is considered to be the location where the vehicle is situated at the time of transfer. The time of transfer of the vehicle is considered to be the time at which the transfer is carried out at the Ministry of Transport with the signatures of the Seller and the Successful Bidder / Buyer.
In the event that at any stage of the auction process, the latter is not successfully completed due to the Seller's fault, or if the subsequent transfer of the vehicle becomes impossible at that stage in the judgment of TutuDeals, the Successful Bidder is released from the obligation to pay the price and is not charged a commission by TutuDeals.
11. Obligations and Declarations of the Buyer
A. In the event that the vehicle ownership transfer process is undertaken by TutuDeals, the Buyer is obliged:
To promptly provide the Platform, by completing the relevant information and uploading the necessary documents in field [...], with the following documents and details required to complete the transfer:
A scanned copy or clear photograph of a valid ID Card or Passport.
Tax Identification Number (AFM) and competent Tax Office (DOY) details.
Residential or registered business address.
Proof of permanent residence (e.g., utility bill, E1 or E9 tax form).
Statutory declaration (Solemn Declaration) accepting the transfer.
It is noted that the Seller may be requested to provide additional documents as required by the competent Authorities or the Platform, depending on the specific characteristics of the vehicle (e.g., road tax certificates, emission certificates, loan repayment proof, etc.).
To provide all necessary assistance to the Platform and respond promptly to requests or notifications regarding the progress of the vehicle transfer.
To attend (if requested) a Citizens' Service Center (KEP), police station, or other competent Authority to sign authorizations or for the certification of their signature (verification of authenticity).
To accept that the transfer is legally completed only upon its successful entry into the Vehicle Registry of the Ministry of Transport and the issuance of the new registration certificate in their name.
To collect the vehicle within five (5) business days from the completion of the sale, either in person or through a transport company of their choice, or via TutuDeals within the framework of the additional delivery service.
To settle within five (5) business days any invoice relating to additional services provided by TutuDeals.
Β. In the event that the Buyer chooses to undertake the transfer of the vehicle in person, they are obliged:
1.
To proceed independently, at their own diligence and responsibility, with the organization and completion of the transfer process at the competent Regional Transport Services or other co-competent bodies.
To coordinate directly with the Seller, or through the Platform, for the signing of all required documents (contracts, applications, statutory declarations, tax clearance certificates, payment of fees, KTEO [technical inspection], etc.).
To provide the Seller or the Platform with the certification of the transfer's completion and the issuance of the new registration certificate in their name.
To formally declare to the Platform that the transfer has been completed, so that the settlement of the special TutuDeals bank account and the payment of the price to the Seller can take place.
To collect the vehicle from the dealership lot after the official completion of the transfer, unless otherwise agreed with TutuDeals itself.
To settle within five (5) business days any invoice relating to additional services provided by TutuDeals.
They acknowledge that in the event of inactivity or delay in the transfer for reasons attributed to them, the Platform reserves the right to cancel the award, withhold expenses, and seek compensation for any direct and/or consequential damages.
They acknowledge that the risk of transporting the vehicle following delivery to them—whether performed by themselves or through a transport company provided as a service by them or TutuDeals—is not borne by TutuDeals.
12. Abnormal Development of Relations between the Buyer and TutuDeals
In the event that the Buyer fails to collect the vehicle, TutuDeals remains entitled to its commission.
In the event that the Buyer breaches any of their contractual obligations, TutuDeals reserves the right to receive its commission as a fee, to immediately suspend and/or permanently delete the Buyer's account, and to bar their participation in future auctions, while simultaneously reserving its right to compensation for any damage caused by the Buyer's breach of contract. In the aforementioned case, TutuDeals may, at its absolute discretion, proceed with the vehicle transfer process with the second-highest bidder in line.
In the event that the sale of the vehicle is not completed due to the Buyer's fault, a contractual penalty equal to 2% of the vehicle's value shall be owed to TutuDeals, which is deemed reasonable and justified.
13 . Force Majeure
TutuDeals bears no liability for delays, failure to perform, or inability to fulfill its obligations or the obligations of Users regarding any or all of its provided services due to events of force majeure, such as, indicatively, natural disasters, fires, floods, earthquakes, pandemics, acts of war, terrorist attacks, government actions, strikes, interruptions in the supply of electricity or natural gas or electronic communication services, as well as any other cause beyond the reasonable control of the Platform.
Furthermore, indicatively, the following cases are cited as failures to fulfill obligations regarding the provided services:
Delay in delivering the vehicle to the Buyer or the dealership lot due to physical obstacles (e.g., floods, landslides, snowstorms).
Inability to provide services related to the transfer (e.g., access to authorities, bureaucratic procedures) due to extreme weather conditions.
Disruption of communication systems or infrastructure (e.g., power supply, telecommunications) that prevents the processing of procedures.
Fires, earthquakes, extreme weather events, or natural disasters that render the vehicle or facilities inaccessible.
Pandemics, epidemics, or government measures (e.g., lockdowns, traffic restrictions) prohibiting the conduct of inspections or deliveries.
Prohibition or obstacles to entry at ports/roads or customs checks preventing transport.
Labor protests, strikes, or transportation stoppages.
Force majeure affecting third-party entities with whom TutuDeals contracts for the provision of its services (e.g., partner workshops, public services).
In such cases, the deadlines for fulfilling obligations are suspended until the force majeure event is lifted. TutuDeals is released from all liability toward all Users of the Platform (General Users, Subscribers, Sellers, Prospective Buyers, and Successful Bidders/Buyers). The Platform must immediately inform Users of the existence of such an event and its impact on the provision of TutuDeals' services. Should the force majeure event last beyond a reasonable period of time, the Platform reserves the right to temporarily or permanently cancel auctions and/or subscriptions, without any obligation to refund subscriptions or provide compensation to Users.
If a User encounters a force majeure event, TutuDeals is not liable for any delay, failure, or inability to fulfill its obligations resulting from that event.
In the event that anyone, either a User or TutuDeals, invokes a force majeure event, they are required to inform all involved Parties in writing (via email or other acceptable communication) within a predetermined time (e.g., within 5 days of becoming aware of the event), to specify the nature, duration, and consequences of the event, and to make every reasonable effort to mitigate the impact. Contractual deadlines are suspended for the duration of the force majeure event, and the fulfillment of obligations may be extended accordingly. If the force majeure event lasts longer than sixty (60) days, each Party may have the right to terminate the agreement (these Terms of Use or the agreement between the Platform and the prospective Buyer, or the Platform and the Seller, or the vehicle sale agreement between the Seller and the Buyer) without compensation to the other Party for obligations that could not be fulfilled due to the force majeure.
If a Party had already provided a service or partially fulfilled an obligation before the event, the issuance of a proportional fee/compensation for the executed portion is permitted.
14. Modification of Terms and Update of Subscriptions
The Platform reserves the right to modify, supplement, or revise these Terms of Use, including terms regarding subscriptions, rights, obligations, and financial charges of the Users, at its absolute and sole discretion. Any modifications shall enter into force following relevant notification to the Users via email, in-Platform notification, or other appropriate means. Continued use of the Platform and participation in auctions after the expiration of this notice period constitutes express acceptance of the new terms by the User. In the event that the User does not accept the changes, they must cease using the Platform and cancel their subscription prior to the effective date of the new terms. Any non-refund of paid amounts due to subscription termination is governed by the applicable terms of the Platform. The Platform also reserves the right to adjust subscription prices by informing Users in the same manner and within the same timeframes. Any change in prices renders the modification immediately binding after the expiration of the notification period, unless the User terminates their subscription in a timely manner.
15. Other Terms
TutuDeals operates exclusively as an Information Society service provider, as defined in Presidential Decree (PD) 131/2003, and for the provision of the services described in term 1.1 hereof, it does not acquire the status of seller or buyer of the vehicles posted on the Platform.
For TutuDeals, among others, the following provisions of PD 131/2003 apply and are implemented:
Article 8: "Without prejudice to the provisions of Presidential Decree 150/2001 (A' 125) on 'electronic signatures', the conclusion of contracts by electronic means is permitted."
Article 11: "In the event of the provision of an information society service consisting of the transmission in a communication network of information provided by a recipient of the service, or the provision of access to a communication network, the service provider is not liable for the information transmitted, on condition that the provider: (a) does not initiate the transmission; (b) does not select the receiver of the transmission; and (c) does not select or modify the information contained in the transmission."
Article 13: "In the event of the provision of an information society service consisting of the storage of information provided by a recipient of the service, the service provider is not liable for the information stored at the request of a recipient of the service, on condition that: (a) the provider does not have actual knowledge of illegal activity or information and, as regards claims for damages, is not aware of facts or circumstances from which the illegal activity or information is apparent; or (b) the provider, upon obtaining such knowledge or awareness, acts expeditiously to remove or to disable access to the information."
The Platform bears no responsibility for the content, information, or offers posted by Users; any liability for the accuracy, legality, or correctness of the posted data rests exclusively with the User who posted them. Should TutuDeals be informed of illegal or unlawful content, it commits to the immediate removal or disabling of access to it, in accordance with applicable legal provisions.
With the exception of the transactions described in the following paragraph, all monetary transactions concerning participation in auctions, awards, payment of the price, and transfer expenses are conducted through a special TutuDeals bank account. Monetary transactions concerning Platform commissions are conducted through an authorized payment service provider, in accordance with Directive (EU) 2015/2366 (PSD2).
The payment of the price to the Seller's account from the special TutuDeals bank account takes place only after the successful completion of the transaction—specifically, the delivery of the vehicle to the Buyer and the completion of the transfer of ownership from the Seller to the Buyer.
Funds are held in a distinct, special TutuDeals bank account and do not constitute the property of TutuDeals, but rather the property of the respective beneficiary.
The Platform does not store User payment details.
Each participation in an auction via the TutuDeals Platform automatically creates a binding contract between the Buyer and the Platform for the execution of TutuDeals' services, including the commitment of funds and monitoring of the transfer, which is deemed signed at the bid submission stage. Submitting a bid constitutes express acceptance of the obligation to execute the contract and to pay the 2% or 1.5% commission, as applicable, on the award price as a service fee. The consumer's right of withdrawal does not apply once the service has been activated.
By participating in the auction process and accepting an offer (on behalf of the Seller) or submitting a bid (on behalf of the prospective Buyer), the Parties declare that they unconditionally accept the transfer process as described in these Terms of Use, as well as the authorizations and administrative actions required.
Upon submission of an auction request by the Seller and its acceptance by TutuDeals, the Platform undertakes the presentation, promotion, and management of the vehicle sale process, without acquiring ownership or any other real or personal right over it. The final starting price is mutually agreed upon between TutuDeals and the Seller, following a technical inspection of the vehicle (either by TutuDeals or arranged by the Seller), its evaluation by TutuDeals, and the finalization of the starting price.
The Platform reserves the right to suspend or delete a User account at its absolute discretion.
The TutuDeals commission amount paid by the Successful Bidder for provided services is non-refundable, except in the case where the Seller culpably breaches their obligations, making the transfer of the vehicle impossible. In such a case, the Successful Bidder is not charged the TutuDeals commission; if the charge has already occurred, the commission amount as well as the purchase price (if already paid into the special TutuDeals bank account) shall be refunded.
The Platform reserves the right to suspend, delay, or cancel access or subscriptions if inaccuracy or incompleteness of data, abusive behavior, or violation of the terms of this agreement and applicable legislation is detected. The user declares that they have taken notice of the terms and unconditionally accept that payment of the subscription fully activates all rights deriving from it, while failure to comply with their obligations may result in temporary or permanent exclusion from the Platform and its services.
16. Reservations
Participation in any auction entails full acceptance of these Terms of Use, which the User expressly declares to have read, understood, and accepted without reservation.
TutuDeals explicitly declares that it does not operate or function in any way as a credit intermediary within the meaning of the relevant provisions of current legislation, including Law 4438/2016, Directive 2014/17/EU, and related regulatory acts. TutuDeals does not provide financial, banking, or credit services, nor does it intermediate for or on behalf of financial institutions for the purpose of granting loans or credits to buyers or sellers. Any information, calculation tool, or other facility provided within the Platform is purely for informational or supportive purposes and does not constitute a proposal, recommendation, or mediation for the conclusion of a credit agreement.
The Platform bears no responsibility for the accuracy, completeness, or correctness of the information, data, or technical characteristics presented for each vehicle. The exclusive responsibility for the full, true, and accurate description of all information and technical characteristics of each vehicle belongs to the respective Seller. TutuDeals is not liable for any delays, technical errors, access interruptions, or software failures that may temporarily affect the Platform's operation, provided they are not due to the Company's intent or gross negligence.
Use of the Platform is at the User's own risk, and the User must take all necessary measures to protect their equipment and data from malicious software or unauthorized access.
Pursuant to Article 3ib of Law 2251/1994, the right of withdrawal provided for in Articles 3e to 3ia of the same law regarding distance and off-premises contracts does not apply to the services provided through the Platform, provided that the Consumer's express consent for the commencement of their execution has been given and the contract has been fully performed. In any event, even if it were assumed that the rights under Law 2251/1994 apply, the Consumer has a period of fourteen (14) days to withdraw from a distance contract without justification and without charge, provided that the provision of the service has not commenced. In the case of TutuDeals, the provision of services begins with the User's registration on the Platform and the acceptance of these Terms. By registering, the User provides express consent for the immediate commencement of the execution of services and acknowledges that, upon full execution of the contract, the right of withdrawal is lost, in accordance with Article 3ib par. a' of Law 2251/1994.
Consequently, from the moment of acceptance onwards, and since the provision has already begun with the User's express consent, the User has consented to the loss of the right of withdrawal, and the service is considered fully provided, in accordance with the exception of case (ia) of Article 3ib of Law 2251/1994.
TutuDeals is not liable for damages that may arise from the use of the information or content of the Platform.
All data, information, photographs, texts, and graphics of the Platform constitute the intellectual property of TutuDeals and are protected by the provisions of Law 2121/1993 as in force; copying or reproduction without the express written permission of TutuDeals is prohibited.
The Company bears no responsibility for the interruption of an auction due to a technical problem, loss of a bid due to User connection problems, or the failure to complete a transaction due to the Seller's breach of obligations, in which case the two percent (2%) commission is returned to the Successful Bidder.
The Platform does not store User payment details and does not acquire proprietary control over the deposited amounts, which are held in a special TutuDeals bank account.
17. Retention of Title Clause
The vehicles remain in the ownership of the Seller until the full and final fulfillment of all the Buyer's obligations toward the Seller.
18. Personal Data:
Detailed information regarding the processing of personal data of natural persons (registered or non-registered users, subscribers, sellers, prospective buyers, successful bidders, buyers) within the framework of the Platform's operation, as well as within the framework of any related activity or process directly linked to the provision of the Company's services taking place outside the Platform, at all stages of the natural persons' relationship with the Company—such as their entry and browsing of the Platform, the registration of vehicles, participation in auctions, the submission of necessary documents, the conclusion of contracts, and the completion of the sale and transfer of vehicle ownership—as well as information regarding the rights of the data subjects and the manner of exercising them, is included in the Information Notice for the Processing of Personal Data posted on the website (link). Users declare that before making any entry of personal data within or outside the Platform, they have read and fully understood the content of the Information Notice.
19. Applicable Law – Jurisdiction – Venue
Any dispute that may arise between Users or between a User and TutuDeals: (a) shall be governed by Greek law; and (b) without prejudice to term 19 below, the Courts with subject-matter jurisdiction at the registered seat of TutuDeals, in accordance with Greek legislation, shall have exclusive jurisdiction for the adjudication thereof, unless otherwise provided by mandatory rules of law.20. Alternative Dispute Resolution
If the User is a consumer within the meaning of Article 1a par. 1 of Law 2251/1994 on consumer protection, then any dispute that may arise in electronic commerce shall be resolved in accordance with the consumer dispute amicable settlement procedure provided for in Law 2251/1994, as these provisions apply from time to time.
TutuDeals informs Users that the following restrictions regarding content moderation exist in the use of the Platform:
